Can we sell our home before the divorce is finalized?
Yes. Many Arizona couples sell their home before the divorce is complete. Your attorney can advise how the proceeds should be handled and whether any temporary court orders affect the sale.
Can one spouse force the sale of the home?
Possibly. Every case is different. If spouses cannot agree, the court may ultimately decide how the property will be handled. Your attorney is the best resource for legal guidance.
What happens to the money from the sale?
The title company doesn't simply divide proceeds equally. Funds are distributed according to written instructions, court orders, settlement agreements, or other legal documentation provided before closing.
Will selling the house delay the divorce?
Not necessarily. In many cases, the real estate transaction and divorce proceedings move forward simultaneously.
